Please read the following Terms of Use and Disclaimer (the "Terms") carefully before using our website, or sending emails to Robolinux.org (the "Site"). By using this Site, or hiring a Robolinux Sysadmin Contractor you agree to these Terms. If you do not agree to these Terms, please do not use the Site or hire a Robolinux Sysadmin Contractor. We reserve the right, at any time, to modify, alter, or update these Terms, and you agree to be bound by such modifications, alterations, or updates.

All creative and technical design, text, graphics, interfaces, interactive elements and the selection and arrangement thereof on the Site are copyright © 2013 Robolinux.org ALL RIGHTS RESERVED. Permission is granted to electronically copy and to print hard copies of portions of the Site for the sole purpose of promoting Robolinux.org using our installation and help instructions or placing an order on the Site or using the Site as a shopping resource.

The materials used and displayed on the Site, including but not limited to all text, software, photographs, graphics, illustrations, artwork, video, music, sound, names, logos and trademarks are, unless otherwise indicated, the property of Robolinux.org its advertisers or licensors and are protected by copyright, trademark, and other laws.

LIMITATION ON LIABILITY
IN NO EVENT SHALL Robolinux.org NOR ANY OF ITS AFFILIATES, AGENTS, REPRESENTATIVES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, OR FOR ACTS OF NEGLIGENCE THAT ARE NOT INTENTIONAL OR RECKLESS IN NATURE, REGARDLESS OF WHETHER Robolinux.org HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WHETHER IN AN ACTION UNDER CONTRACT, NEGLIGENCE, OR ANY OTHER THEORY, ARISING OUT OF OR IN CONNECTION WITH THE USE, INABILITY TO USE, OR PERFORMANCE OF THE INFORMATION, SERVICES, PRODUCTS, AND MATERIALS AVAILABLE FROM THE SITE. BECAUSE SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, OR THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. Total liability hereunder for damages, regardless of the nature of any claim or form of any action, shall not exceed the total amount that has been paid to Robolinux.org ; by such claimant.


UNSOLICITED OR UNWANTED EMAILS SENT TO ROBOLINUX
Robolinux will not tolerate any Individual or Company sending "UNSOLICITED or UNWANTED EMAILS" to any robolinux.org email account. Therefore if you send any "UNSOLICITED or UNWANTED EMAILS" to Robolinux you will be sent a request to stop sending "UNSOLICITED or UNWANTED EMAILS" to Robolinux.

UMWANTED EMAILS INCLUDES ANY AUTOMATED ROOT EMAILS SENT TO ROBOLINUX BY A CUSTOMER's COMPANY SERVER.

After the 10th warning email has been sent to the Individual or Sender's Company, Robolinux will "FINE" the Individual or Sender's Company a minimum of $100 USD per each "UNSOLICITED or UNWANTED EMAIL" sent to Robolinux. The Individual Sender or the Company Sender will be sent a "FINE INVOICE" via email in PDF format for the exact number of "UNSOLICITED or UNWANTED EMAILS".

If the Individual or Company fails to pay in full the Robolinux "UNSOLICITED OR UNWANTED EMAILS" "FINE INVOICE" in USD currency within 7 days of the date of the invoice sent via email, then Robolinux will IMMEDIATELY report the Individual or Company's "From email address(s)" and its "MAIL SERVERS IP ADDRESSES" and "ALL OF THE INDIVIDUAL'S OR COMPANY'S WEBSITE(S) IP ADDRESSES" to every "SPAM OR UNSOLICITED EMAIL BLACK LIST" available on the internet.

In addition Robolinux will IMMEDIATELY ENFORCE every available LEGAL method of recovering 100% of the "UNSOLICITED or UNWANTED EMAILS" "FINE INVOICE" amount due to Robolinux in USD currency. Further Robolinux will report the Individual or Company to "ALL CREDIT RATING BUREAUS" in the country where the Individual or Company resides.

SUPPORT POLICIES
Robolinux provides limited expert telephone, email & Chat support during posted business hours. Please read the specific "Limits & Requirements" clearly outlined below.


 Worldwide Hours of Operation:

Monday through Friday.
7AM to 11AM Eastern Standard Time.
8PM to 12PM Eastern Standard Time.

The Robolinux Offices are closed on weekends and holidays.

*Robolinux Operating System support Limits & Requirements:
Please note you must provide a Hardware Information + Profiler Report when requesting a custom Wifi or Printer Driver.

Please note since the Robolinux Operating System is free if you require extensive Tech Support i.e. For a Company, or for multiple machines or you are a PC Beginner you must order an "Extensive Optional Tech Support package". You can place your order on our Downloads webpage. Thank you!

*eMail per Support case Limits & Requirements:
1. Per case is limited to one question.
2. eMail per Support case does not include telephone support. If you require phone support you must order an extensive Support Package from our downloads webpage.

**Stealth VM Software support Limits & Requirements:
1. eMail support will be answered within 1 to 2 hours during posted business hours.
2. Stealth VM Software support does not include Robolinux Operating System or telephone support. If you require phone support you must order an extensive Support Package from our downloads webpage.
All eMail sent after hours will be answered the following business day.
3. The maximum number of PC's or laptops supported per Stealth VM Software donation is one. i.e. If you have 2 PC's or laptops in total then you must purchase an "Extensive Optional Tech Support Package" if you require support for the second PC or laptop.

***The C: Drive to VM Support Package Limits & Requirements:
1. eMail support will be answered within 1 to 2 hours during posted business hours.
2. The C: Drive to VM Support Package does not include Robolinux Operating System or telephone support. If you require phone support you must order an extensive Support Package from our downloads webpage.
All eMail sent after hours will be answered the following business day.
3. Chat support must be scheduled by email 30 minutes in advance.
4. The maximum number of PC's or laptops supported per C: Drive to VM Support Package donation is one. i.e. If you have 2 PC's or laptops in total then you must purchase an "Extensive Optional Tech Support Package" if you require support for the second PC or laptop.

TECH SUPPORT TERMINATION POLICY
Robolinux.org has the right to refuse Tech Support or immediately terminate any Tech Support case or "Extensive Optional Tech Support Package", if a Customer refuses to follow the Technical Support Rep's directions or posted Support guidelines or threatens, is abusive, insulting or uses foul language towards any of the Technical Support Representatives via email, chat or Phone communications. Any violation of the Robolinux.org "Terms of Use" policy will result in an immediate termination of all Tech Support provided to the User and 100% forfeiture of any monetary donations or payments made.

FEES AND CHARGES
Robolinux.org fees and charges may change from time to time. We may introduce new products and services at special introductory pricing. At our discretion, we may change pricing. Where required by law, we will send notification of any modifications or changes to your email address on file with us.

ACCEPTANCE OF AN ORDER
The receipt of an e-mail order confirmation does not constitute the acceptance of an order or a confirmation of an offer to sell. Robolinux.org reserves the right, without prior notification, to limit and/or refuse service to any customer. Verification of information may be required prior to acceptance of an order.

DELIVERY POLICY
Your donation order will be processed within seconds of placement. You will be contacted if there are delays in processing your order.

ILLEGAL ACTIVITY
Any activity on our network that is a violation of any state or federal law is a violation of this policy and will result in immediate termination of service for Illegal Activity as defined herein: You may not use the web site to:

1. Transmit obscene materials

2. Intentionally spread or threaten to spread computer viruses

3. Gain or attempt to gain unauthorized access to any network, including Robolinux.org 's network operating center infrastructure

4. Access or attempt to access information not intended for you

REFUND POLICY
At Robolinux.org we strive to maintain the highest quality of standards. If you are not satisfied you can request and receive a refund for your donation if you qualify. Then you will receive a refund minus the Paypal transaction and refund fees incurred by you within 3 business days.

Refund Requirements:
1. A Customer's PC or laptop that is found to be broken after they have received eMail or Phone Technical Support do not qualify for a donation refund.

2. Customers who refuse to follow a Robolinux Tech Support Personnel's instructions do not qualify for a donation refund.

3. Customers who have already received Robolinux eMail and or Phone Technical Support do not qualify for a donation refund. This includes the Steatlth Vm Software and C: Drive to VM Support Package.

4. You must send a donation refund request by email to Robolinux Support within 30 days of your original donation date.

LINKED WEBSITES
Robolinux.org and its advertisers do not review or monitor any websites linked to the Site and are not responsible for the content of any such linked websites. Your use of such websites is at your own risk.

GOVERNING LAW
The Terms and any disputes arising out of or related to use of the Site including, without limitation, the information, services, products and materials contained therein, shall be governed by, and construed and enforced in accordance with, the laws of the State of California, giving no effect to its conflicts of law principles.

VENUE
You hereby submit to the exclusive jurisdiction of the federal and state courts of California with respect to any dispute, controversy or unpaid "FINES" for "UNSOLICITED or UNWANTED EMAIL" regarding these Terms or arising out of or related to use of the Site and you or your Companies or Corporartions hereby submit to the personal jurisdiction in any such action.
